Terms and Conditions
When you place an order in the Jan van Setten Shop, you agree to the following terms and conditions.
In these terms, we refer to the term ‘buyer’ as: the legal entity or natural person who has instructed Jan van Setten Shop to deliver goods or services.
‘BIG Unlimited B.V.’ is the owner of ‘Jan van Setten Shop.’ This company is registered with the Chamber of Commerce under number 24320018 and is located at Arnhemseweg 2, Floor 1 Unit 9, 3817CH in Amersfoort.
The VAT number is 8097.33.110.B01.

These terms and conditions apply to all online orders from the ‘buyer’ in the ‘Jan van Setten Shop.’
- The buyer makes an offer through the electronic webshop. Jan van Setten Shop accepts the order by sending a confirmation email to the provided email address of the buyer.
- Offers are valid as long as they are stated on the Jan van Setten Shop and as long as stock is available.
Prices of products in the Jan van Setten Shop are expressed in euros. Prices include VAT and exclude shipping and handling costs, unless otherwise indicated. Books are subject to a VAT rate of 9%, while other online orders are subject to a VAT rate of 21%.
In the event that the price of the offer or product, as stated in the Jan van Setten Shop and/or in the confirmation email, contains errors or is incorrect, Jan van Setten Shop reserves the right to amend or correct it within a reasonable timeframe. The buyer will be promptly informed in writing, by email, or by phone by Jan van Setten Shop. In the case of a price increase, the buyer has the option to cancel the purchase agreement.
Payments can be made through iDEAL and PayPal. If, despite these payment methods, Jan van Setten Shop has a claim against the buyer, Jan van Setten Shop reserves the right to charge interest of 1% per month after a two-week period. If Jan van Setten Shop needs to transfer a claim against the buyer to a collection agency, all associated costs will be borne by the buyer.
Jan van Setten Shop commits to delivering the order to the buyer in accordance with the description, requirements, and quality as specified on the website. The order will also be properly packaged and securely protected to ensure they reach their destination in good condition under normal transportation conditions.
Orders placed from Monday to Thursday will be dispatched within 48 hours, unless otherwise indicated for the specific product. Free shipping in the Netherlands is available for orders over €15. For orders below this amount, shipping costs in the Netherlands are €1.95. Shipping to Belgium is €4.95.
In case of a delivery delay of more than fourteen (14) days after the order, the buyer has the right to a refund of the purchase amount, including the paid shipping costs, but is not entitled to consequential, delayed, profit, or turnover damage.
Delivery and billing take place in the Netherlands and Belgium and are limited to individuals or companies located in the Netherlands or Belgium.
If the products cannot be delivered directly from stock, Jan van Setten Shop will provide an expected availability date for the products.
The order will be delivered to the address indicated by the buyer during the order placement and confirmed by Jan van Setten Shop in the confirmation email.
Delivery of orders, both within and outside the Netherlands, is carried out through PostNL and DHL.
*The above applies to physical products; digital products are received by the buyer immediately and events are ‘delivered’ on the day of the event.
In the event that an order does not meet the quality, requirements, or description as specified by Jan van Setten Shop, the buyer must inform Jan van Setten Shop by email within fourteen (14) working days after receiving the product regarding non-conformity and any damage to the product (the email and visit address of Jan van Setten Shop are detailed in the terms and conditions).
In the event that a product does not meet the quality, requirements, or description as specified by Jan van Setten Shop, the buyer has the right to return the products. The buyer is entitled to free repair of the product or replacement with a similar product. If the product is no longer available, the buyer is entitled to a refund of the purchase amount, including any paid shipping costs.
Jan van Setten Shop is not liable for defects or wear and tear on the product due to neglectful maintenance, improper use, or normal wear and tear of a product
Except as provided in the preceding article (delivery) of the terms and conditions, the risk of loss, damage, or depreciation passes to the buyer at the moment the order is delivered to the address provided by the buyer. If, and to the extent that, the order has been unsuccessfully delivered to the buyer’s provided address, the risk transfers at the moment of the delivery attempt.
- Jan van Setten Shop retains ownership of the products until the buyer has fully paid the purchase price for the products, despite the actual delivery of the products.
- The buyer is not authorized to resell, pledge, or otherwise encumber the products subject to ownership retention.”
All intellectual property rights of the Jan van Setten Website and Shop are owned by BIG Unlimited B.V. Therefore, the buyer is not allowed to use the intellectual property rights in the broadest sense of the word without prior permission from BIG Unlimited B.V. (for example, by copying images or text).
- Despite the fact that Jan van Setten Shop is very careful in providing correct, clear pricing, accurate descriptions, requirements, and quality of the displayed products on the website, Jan van Setten Shop is not liable for any errors, inaccuracies, or incompleteness on its website and/or confirmation email. Jan van Setten Shop reserves the right to correct these errors, inaccuracies, or incompleteness at any time.
- Jan van Setten Shop is not liable for any damage the buyer may suffer due to delays, non-delivery, or incomplete delivery of orders – for example, due to a (temporary) technical issue on the website, or between Jan van Setten Shop and third parties, including the electronic payment system, and any potential consequences thereof, unless there is gross negligence or willful misconduct on the part of Jan van Setten Shop.
- In any case, the liability of Jan van Setten Shop for damages is limited to a maximum of the purchase price and any paid shipping costs. Jan van Setten Shop is not liable for any consequential, delayed, profit, or turnover damage suffered by the buyer.
In the case of an online physical order, an individual buyer has the right to revoke the order without providing a reason within fourteen (14) working days after receiving the order. This right does not apply to orders of more than 10 items per item.
Revocation of the physical order can be done by email (via winkel@janvansetten.nl), with the notice being received by Jan van Setten Shop within the mentioned timeframe. The costs of the return shipment are the responsibility of the buyer.
In the event of revocation, Jan van Setten Shop will refund the purchase price paid by the buyer, excluding any paid shipping costs, within a maximum of thirty (30) days after receiving the returned order when and once the returned order is found to be free from defects and damage by Jan van Setten Shop.
*Downloads and event tickets cannot be canceled.
In the event of force majeure, Jan van Setten Shop has the right to unilaterally postpone the processing of an order or to entirely terminate the agreement. The buyer will be notified in writing in such cases, and Jan van Setten Shop is not obliged to provide compensation.
- Dutch law applies to the agreements between Jan van Setten Shop and the buyer. Any disputes will be exclusively submitted to a competent court in the Netherlands.
- After Jan van Setten Shop has asserted in writing to the buyer the application of the preceding paragraph of the terms and conditions, the buyer has the option to indicate within one month after that assertion that they wish to have the dispute resolved by the court as designated by the law.
